Compte tenu de la condamnation pr\u00e9cipit\u00e9e du conducteur du v\u00e9hicule qui aurait percut\u00e9 la moto sur laquelle circulait le journaliste et du manque de transparence de l\u2019enqu\u00eate, une proc\u00e9dure cr\u00e9dible doit \u00eatre engag\u00e9e.<\/p>\n<p>Le 19\u00a0janvier 2023, la police rwandaise a <a href=\"https:\/\/www.newtimes.co.rw\/article\/4361\/news\/rwanda\/local-journalist-dies-in-car-accident\" target=\"_blank\" rel=\"noopener noreferrer\">annonc\u00e9<\/a> que John Williams Ntwali avait trouv\u00e9 la mort dans un accident de la route dans le quartier de Kimihurura, \u00e0 Kigali, le 18\u00a0janvier \u00e0 2h50, et que le conducteur du v\u00e9hicule impliqu\u00e9 dans la collision avait \u00e9t\u00e9 arr\u00eat\u00e9. John Williams Ntwali, fondateur de la cha\u00eene YouTube Pax\u00a0TV-IREME et r\u00e9dacteur en chef du journal priv\u00e9 <em>The Chronicles<\/em>, d\u00e9non\u00e7ait des atteintes aux droits humains commises au Rwanda et avait re\u00e7u des menaces par le pass\u00e9. Peu de temps avant sa mort, il s\u2019\u00e9tait dit inquiet pour sa s\u00e9curit\u00e9. Malgr\u00e9 les suspicions entourant son d\u00e9c\u00e8s et l\u2019int\u00e9r\u00eat \u00e9lev\u00e9 suscit\u00e9 par cette affaire, aucune information suppl\u00e9mentaire n\u2019a \u00e9t\u00e9 fournie avant le 7\u00a0f\u00e9vrier, date \u00e0 laquelle le tribunal a annonc\u00e9 aux journalistes que le proc\u00e8s s\u2019\u00e9tait tenu en une seule audience le 31\u00a0janvier et que le conducteur de la voiture avait \u00e9t\u00e9 d\u00e9clar\u00e9 coupable d\u2019homicide involontaire et de coups et blessures non intentionnels. Aucun observateur ind\u00e9pendant ni journaliste n\u2019a assist\u00e9 au proc\u00e8s. Le verdict a \u00e9t\u00e9 rendu par le tribunal de base de Kagarama, \u00e0 Kigali.<\/p>\n<p>Dans sa d\u00e9cision \u00e9crite, le tribunal indique que l\u2019accident a eu lieu dans une rue non identifi\u00e9e situ\u00e9e \u00e0 proximit\u00e9 de l\u2019Universit\u00e9 la\u00efque adventiste de Kigali, rue que le conducteur de la voiture aurait emprunt\u00e9e pour \u00e9viter un contr\u00f4le de police sur la route principale car il n\u2019avait pas de certificat de contr\u00f4le technique valide. Le tribunal pr\u00e9cise que la voiture en exc\u00e8s de vitesse a heurt\u00e9 la moto par l\u2019arri\u00e8re dans cette rue non \u00e9clair\u00e9e, projetant \u00e0 terre John Williams Ntwali, qui \u00e9tait passager de la moto. Le journaliste serait mort sur le coup, tandis que le conducteur de la moto n\u2019aurait \u00e9t\u00e9 que l\u00e9g\u00e8rement bless\u00e9. Le conducteur de la voiture a \u00e9t\u00e9 condamn\u00e9 \u00e0 une amende d\u2019un million de francs rwandais (environ 920\u00a0dollars des \u00c9tats-Unis), apr\u00e8s avoir semble-t-il reconnu les faits.<\/p>\n<p>L\u2019absence d\u2019informations d\u00e9taill\u00e9es dans le verdict laisse \u00e0 penser qu\u2019aucune v\u00e9ritable enqu\u00eate n\u2019a \u00e9t\u00e9 men\u00e9e sur la mort de John Williams Ntwali, bien que les autorit\u00e9s rwandaises soient juridiquement tenues de veiller \u00e0 ce que ce soit le cas, ont d\u00e9clar\u00e9 les signataires de l\u2019appel. Le verdict ne donne pas le lieu pr\u00e9cis de l\u2019accident. Il n\u2019indique pas non plus s\u2019il existe des preuves photographiques ou vid\u00e9os de la sc\u00e8ne de l\u2019accident, alors m\u00eame qu\u2019il mentionne que la police de la circulation a \u00e9t\u00e9 appel\u00e9e et s\u2019est rendue sur place. Il ne pr\u00e9cise pas si le journaliste portait un casque, ce qui est obligatoire au Rwanda.<\/p>\n<p>Le verdict fait r\u00e9f\u00e9rence \u00e0 un rapport m\u00e9dical, mais les informations restent vagues, indiquant simplement que la mort de John Williams Ntwali est due \u00e0 un accident qui a provoqu\u00e9 de multiples blessures et fractures ainsi qu\u2019une importante h\u00e9morragie. Aucune information n\u2019est fournie sur l\u2019identit\u00e9 de la personne qui a r\u00e9alis\u00e9 l\u2019examen m\u00e9dical ni sur le lieu et la date de celui-ci.<\/p>\n<p>Compte tenu de l\u2019absence de pr\u00e9cisions sur ces \u00e9l\u00e9ments, qui laisse \u00e0 penser qu\u2019aucune v\u00e9ritable enqu\u00eate n\u2019a \u00e9t\u00e9 men\u00e9e, et du manque de transparence qui entoure le proc\u00e8s, nous, organisations soussign\u00e9es, <a href=\"https:\/\/www.amnesty.org\/fr\/documents\/afr47\/6400\/2023\/fr\/\" target=\"_blank\" rel=\"noopener noreferrer\">appelons une nouvelle fois<\/a> les autorit\u00e9s rwandaises \u00e0 permettre l\u2019ouverture d\u2019une enqu\u00eate ind\u00e9pendante, impartiale et efficace sur les circonstances suspectes de la mort de John Williams Ntwali.
