Eux qui avaient cl\u00f4tur\u00e9 cette enqu\u00eate il y a tout juste trois mois. Une r\u00e9ouverture de l&rsquo;instruction qui a surpris les parties civiles. Il y aurait un ou plusieurs \u00e9l\u00e9ments nouveaux dans l&rsquo;affaire.<\/em><strong><!--more--><\/strong><\/p>\n<p>Du c\u00f4t\u00e9 du parquet fran\u00e7ais, on pr\u00e9cise que l&rsquo;instruction reprend, car les juges d&rsquo;instruction ont besoin de poser de nouveaux actes judiciaires. Sans en expliquer la teneur. Depuis la cl\u00f4ture de l&rsquo;instruction, les parties dans ce dossier avaient justement trois mois pour demander des actes compl\u00e9mentaires. Mais aucun des avocats interrog\u00e9s par RFI, que ce soit du c\u00f4t\u00e9 des parties civiles ou des accus\u00e9s, ne reconna\u00eet avoir fait une telle demande.<\/p>\n<p>Tous estiment donc qu&rsquo;il doit y avoir des \u00e9l\u00e9ments nouveaux. De sources concordantes, il s&rsquo;agirait d&rsquo;un ou de plusieurs nouveaux t\u00e9moins qui se seraient pr\u00e9sent\u00e9s par l&rsquo;interm\u00e9diaire d&rsquo;avocats aux juges d&rsquo;instruction fran\u00e7ais. Qui sont-ils ? Pourquoi ne se pr\u00e9sentent-ils que maintenant ?<\/p>\n<p>Une chose est s\u00fbre, il ne s&rsquo;agit pas du g\u00e9n\u00e9ral Kayumba Nyamwasa, coaccus\u00e9 dans cette affaire et exil\u00e9 en Afrique du Sud. M\u00eame si l&rsquo;ancien chef d&rsquo;\u00e9tat-major du Rwanda avait encore r\u00e9cemment manifest\u00e9 \u00e0 la justice fran\u00e7aise sa volont\u00e9 d&rsquo;\u00eatre entendu par une lettre. La commission rogatoire internationale permettant son audition simple et la notification des charges qui p\u00e8sent contre lui court toujours. Cette audition, si le gouvernement sud-africain se d\u00e9cidait \u00e0 l&rsquo;autoriser, n&rsquo;aurait pas n\u00e9cessit\u00e9 la r\u00e9ouverture de l&rsquo;instruction.<\/p>\n<p>L&rsquo;instruction rouverte, les parties civiles ne cachent pas leur surprise, disent avoir h\u00e2te d&rsquo;en savoir plus. Du c\u00f4t\u00e9 des avocats des accus\u00e9s, on d\u00e9clare n&rsquo;avoir aucune inqui\u00e9tude et on annonce d\u00e9j\u00e0 l&rsquo;intention de redemander un non-lieu d\u00e8s que l&rsquo;instruction sera \u00e0 nouveau cl\u00f4tur\u00e9e.
